THE ARBITRATION SHALL BE CONDUCTED IN ENGLISH AND SHALL TAKE PLACE ON AN INDIVIDUAL BASIS.
By agreeing to these Terms, you and Punch Pizza each waive the right to a jury trial and the right to participate in class action litigation. The arbitrator shall have the authority to award any relief that a court of competent jurisdiction could award. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
12.3 Class Action Waiver
YOU AND PUNCH PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Punch Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
